Judgment in Germany: hunting association is not an animal welfare organisation

In the German State North Rhine Westphalia (NRW), a class action has been introduced since 2013 for animal welfare organisations. A hunting association asked the Ministry of environment  to be registered as Animal Welfare Organisation to get the privilege of using the class action in this state. The Ministry did not accept this request and the hunting organization has filed a complained against the Ministry, and there was and administration court case.  

The judge of the administration court in Gelsenkirchen rejected the request of the hunting organization to be registered as an Animal Welfare Organisation. In consequence they have no legal base for using the tool of class action for animal welfare, as this is possible for seven registered AWOs in North Rhine Westphalia.

The class action is logic legal political consequence of the federal state goal Animal Welfare, based in Art. 20a of the German constitution since 2002. The class action Animal Welfare has been established in the meantime in seven of 16 states of Germany (Baden-Württemberg, Bremen, Hamburg, North Rhine Westphalia, Reinland Pfalz, Saarland, Schleswig Holstein). Six of these states have a red or red and green government, one, Saarland, has a right-left coalition.

In the court case mentioned above we see that also this tool clearly established for the balance and in the interest for the sake of the animals and granting a proper enforcement of the respective AW legislation, by correcting wrong administration decisions against the animals or stating that the decision of an administration is wrong, should be misused here by hunters, but the judgement was very clear.

North Rhine Westphalia has a state government composed by Socialists and Greens. The minister for climate, environment, agriculture, nature conservation and consumer protection is lead by a Green state minister.

The class action of North Rhine Westphalia was established in 2013 and has the broadest scope for AWOs activities and contributions, they have also participation rights e.g. to be heard already during a legislation procedure. NRW is also the state with most registered AWOs: seven. In the other states there are only one or up to three registered, in some states there are common offices of AWOs. There is also a certain diversity of empowerment, however all of them enable the AWOs to do a so called positive or negative declaratory action, and five have also a more far reaching right for rescission (or called action to rescind).

Outrage in UK as the Government as the Government released details of the 3.87million experiments carried out on mammals, birds and fish last year

On October 22nd 2015, the UK government released details of the 3.87million experiments carried out on mammals, birds and fish last year. These information has lead to the angriness of animal welfare organisations across UK.

The experiments were described as causing “'unacceptable levels of suffering” and the Government came under attack for failing to reduce the numbers of animals used in laboratories

Idaho (USA) Judge overturns the law prohibiting undercover video on animal abuse

This is a good news for animal welfare organisations of Idaho, United States. The scandalous law aiming to make a crime of undercover investigation inside agricultural facilities has been declared as violating the constitutional right to free speech. 

The "ag gag law" was introduced in 2012 after the release of a video exposing cruelty and neglect in farms. Following this videos, several farmers were condemned for animal abuse and mistreatments.

France: After the Senate denied sensibility to animals, the National Assemblee reaffirmed it

On January 22nd, the Senate has rejected an amendment to the French Civil Code, introduced by the National Assemblee aiming to recognize that animals are sentient beings. 

In the French Rural Code, kept domestic animals are already recognised as sentient beings, and the Criminal Code penalized animal mistreatments. But the Civil Code still considered animals as goods. Following a massive ask of the citizens and also of 24 French intellectuals (see more), an amendment was introduced last year by the MP Glavany in order to change the Civil legal status of the animals. This amendment was already the result of harsh negociations between the MPs, as many of them are hunters. Therefore the amendment stated that only "kept" animals are sentient beings, excluding wild animals of its scope. It had already been hardly criticised by animal welfare organisations (see more). 

But on 28 January 2015, the National Assemblee has finally re-implemented the amendment deleted by the Senate. Therefore, the amendment is adopted and provides that animals are "living beings gifted sentience".

Switzerland: an "Animal Alliance" to improve animal welfare

The Swiss Animal Welfare Organisation Tier Im Recht together with three other animal welfare organisations including FOUR PAWS Switzerland has created a "Alliance Animale Suisse" (Swiss Animal Alliance) in order to promote animal welfare at the political and legal level.

Australia: a political coalition to "protect" intensive farmers against animal welfare organisations

The Agriculture Minister of Victoria (one State of Australia) has announced that he will ensure that a law on the "protection" of food producers against animal welfare organisations will be edicted. This law was already a promess done by him during the 2010 election campaign. 

The Minister Mr Walsh, said that "it's particularly important to protect intensive poultry and pig farmers, because of biosecurity threats from intruders".

Australia: stricter rules for Internet seller of puppies

The new Animals Sales Code came into force on October 21 2013. The new law is providing stricter controls of breeders sellong pets on the Internet, as well as stricter enforcement powers to animal welfare organisations.

An Animal Welfare Bill will be voted in Malaysia

On June 24th, the parliament of Malaysia will meet for the first time. This meeting is awaited by many animal welfare organisations because the Government promised that an Animal Welfare Bill will be introduced. This bill could be a big step for animal welfare in Malaysia at it proposed to sanction with fines and emprisonment acts of animal cruelty.
